These Terms of Use apply to access to and use of EOL_ONE, the Equipment on Loan software service operated by Kaffeina Group Pty Ltd.
1. Acceptance
By accessing or using EOL_ONE, you agree to these Terms of Use. If you do not agree, you must not access or use the platform.
2. About EOL_ONE
EOL_ONE is provided as a software service to help authorised businesses manage customers, commercial agreements, equipment on loan records, asset history, documents, backups, and audit information.
3. Authorised Users
You may only use EOL_ONE if you are authorised by Kaffeina Group Pty Ltd or by the organisation responsible for your account. You must keep login details secure and must not share access with unauthorised people.
4. Customer and Business Data
Users are responsible for ensuring that information entered into EOL_ONE is accurate, lawful, and appropriate. You must not upload or enter information that you do not have permission to use.
5. Acceptable Use
You must not misuse the platform, attempt to bypass security, interfere with operation, access data you are not authorised to access, upload malicious files, or use EOL_ONE for unlawful purposes.
6. Documents and Records
EOL_ONE may generate or store agreements, schedules, notices, PDFs, backup files, and audit records. Users should review generated documents carefully before relying on, sending, or signing them.
7. Availability and Backups
We aim to keep the EOL_ONE software service reliable and available, but we do not guarantee uninterrupted access. Maintenance, outages, backups, restores, upgrades, or third-party service issues may affect availability.
8. Intellectual Property
EOL_ONE, including its software, layout, branding, workflows, and platform content, is owned by or licensed to Kaffeina Group Pty Ltd. You may use it only as permitted for authorised business purposes.
9. Limitation of Liability
To the maximum extent permitted by law, Kaffeina Group Pty Ltd is not liable for indirect, consequential, incidental, special, punitive, loss-of-profit, loss-of-revenue, loss-of-goodwill, loss-of-data, business interruption, or similar damages arising from or connected with access to, use of, inability to use, or reliance on EOL_ONE.
To the maximum extent permitted by law, Kaffeina Group Pty Ltd's total aggregate liability for claims connected with EOL_ONE is limited to the amount paid by the relevant customer for the software service in the three months before the event giving rise to the claim, or AUD $100 where no amount was paid.
Nothing in these Terms excludes, restricts, or modifies rights, guarantees, remedies, or liabilities that cannot be excluded, restricted, or modified under Australian law.
10. Suspension or Termination
Access may be suspended or removed if an account is no longer authorised, if these Terms are breached, if security is at risk, or if continued access may affect the platform or other users.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia. The parties submit to the courts with jurisdiction in Victoria, Australia.
